The Subject Of This Tender Is The Conclusion Of A Framework Agreement For The Professional And Legally Compliant Acceptance, Storage, Sampling, Utilization And Disposal Of Excavated Soil Material Of Classes Bm-0, Bm-0*, Bm-F0*, Bm-F1, Bm-F2, Bm-F3 As Well As Landfill Classes Dk 0, Dk 1, Dk 2, Dk 3. In Addition, The Procurement Item Includes The Acceptance, Recycling Or Disposal Of Bituminous Road Construction. Reference Is Also Made To The Service Description. The Services Include Acceptance, Weighing In And Out Using Calibrated Scales, Documentation Of The Weighing Results, Separating The Soil-Construction Rubble Mixtures, Unloading And Loading Using Chargers, Storage On Liquid-Tight Soil Protected Against The Effects Of The Weather, Taking Soil Samples According To Pn 98 And Soil Analysis By An Accredited Laboratory. The Acceptance Point(S) For The Excavated Soil Material And The Bituminous Road Demolition Must Be Located In The Area Of The City Of Leverkusen. Firstly, This Is Objectively Justified For Economic Reasons. So Far, The Civil Engineering Companies That Deliver The Excavated Material And The Bituminous Road Materials Only Go To Collection Points In The Leverkusen City Area. An Obligation To Deliver To Collection Points Located Further Away Would Not Be Reasonable For Them, Or At Least Not Easily, As This Would Result In Considerable Additional Transport Costs. The Background Is That The Civil Engineering Companies Receive A Flat-Rate Fee That Is Calculated Exclusively On Deliveries To Landfills In The Area Of The City Of Leverkusen. Secondly, The Local Restriction Is Necessary For Ecological Reasons. Short Transport Routes Reduce Transport Emissions, Which Contributes To A Reduction In Environmental Impact. Taking Such Environmental Aspects Into Account Is Permissible And Required Under Procurement Law (Cf. Olg Frankfurt A. M., Decision Of March 29, 2018, 11 Verg 16/17). The Client Makes A Binding Commitment To The Following Minimum Purchase Quantities Per Year From The Framework Agreement: - Utilization Of Excavated Soil Material Bm-0 5,000 Tons (T) - Utilization Of Excavated Soil Material Bm-0* 5,000 Tons (T) - Utilization Of Excavated Soil Material Bm-F0* 5,000 Tons (T) - Utilization Of Excavated Soil Material Bm-F1 3,000 Tons (T) - Utilization Of Excavated Soil Material Bm-F2 1,000 Tons (T) - Recycling Of Excavated Soil Material Bm-F3 5,000 Tons (T) - Disposal Of Excavated Soil Material Dk 0 250 Tons (T) - Disposal Of Excavated Soil Material Dk 1 250 Tons (T) - Disposal Of Excavated Soil Material Dk 2 250 Tons (T) - Disposal Of Excavated Soil Material Dk 3 50 Tons (T) - Separation Of Bm-0 Soil Excavated Material 5,000 Tons (T) - Interim Storage 8,000 Tons (T) - Transshipment Storage 20,000 Tons (T) - Recycling/Removal Of Bituminous Road Demolition 4,000 Tons (T) - Container Arrival And Departure 75 Tours - Relocation Collective Rental 900 Tons (T) Furthermore, The Framework Agreement Does Not Justify Any Ans
