The Subject Of The Order Is Service Inspections And Repairs Of Medical Equipment. A Detailed Description Of The Subject Of The Order Is Set Out In Annex No. 2 To These Terms Of Reference. Service Inspections Will Take Place At The Frequency Recommended By The Equipment Manufacturer. The Contractor Is Obliged To Make An Appropriate Entry In The Technical Passport For A Given Device And Confirm The Work Performed In The Work Card And/Or Issue A Service Report Taking Into Account The Detected Defects. The Contractor Provides Original Spare Parts. With The Consent Of The Ordering Party, It Is Allowed To Use The So-Called Substitutes. Spare Parts Used For Repairs Will Be New And Of Full Value And Have Technical Parameters No Worse Than The Original Parts. Obligation To Service Medical Equipment In Accordance With The Act Of April 7, 2022 On Medical Devices (Consolidated Text: Journal Of Laws Of 2024, Item 1620). The Contractor Undertakes To Perform The Subject Of The Order In Accordance With All The Requirements Of The Ordering Party Indicated In This Tor. All Requirements Specified In The Documents Indicated Above Are Minimum Requirements, And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law. If The Ordering Party Has Indicated In The Description Of The Subject Of The Order Trademarks, Patents Or Origins, Sources Or A Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Is Allowed To Offer Solutions Equivalent To Those Described, Provided That They Maintain The Same Minimum Technical, Quality And Functional Parameters. If The Description Of The Subject Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Ordering Party Allows Solutions Equivalent To Those Described. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards.
