1. The Subject Of The Order Is The Development Of A Functional And Utility Program For The Investment Task Titled Reconstruction Of Building No. 1 Of The Legionowo Csp.2. The Full Scope Of Work Is Included In The Extract From The Investment Program, Which Constitutes Annex No. 1 To The Swz. 3. The Subject Of The Order Will Be Completed Within 60 Days From The Date Of Signing The Contract.4. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Essential Provisions Of The Agreement, Constituting Annex No. 7 To Swz.5. The Contractor Will Prepare A Functional And Utility Program In Accordance With The Act Of July 7, 1994 - Construction Law (Journal Of Laws Of 2025, Item 418, As Amended), Hereinafter Referred To As The Construction Law, Regulation Of The Minister Of Development And Technology Of December 20, 2021 (Journal Of Laws Of 2021, Item 2454) In Regarding The Detailed Scope And Form Of The Functional And Utility Program, The Act And Applicable Regulations, Standards And Principles Of Technical Knowledge.6. The Documentation Is Intended To Enable Public Procurement Proceedings To Be Carried Out In The Design And Build Formula.7. The Functional And Utility Program Will Include: - General Description Of The Subject Of The Order; - Characteristics Of The Facility; - Functionality; - Description Of The Ordering Partys Requirements In Terms Of Functions, Technical And Operational Parameters; - Requirements Regarding Land Development; - Requirements In The Field Of Environmental Protection, Energy Efficiency And Accessibility; - Information Part, Including Data On Formal And Legal Conditions, Photographic Documentation, Warranty Description; - List Of Costs Of Planned Design Works And Construction Works.8. The Contractor Undertakes To Prepare The Documentation In A Complete, Consistent And Fault-Free Manner.9. The Contractor Declares That He Has The Knowledge, Experience And Qualifications Necessary To Perform The Subject Of The Order.10. The Contractor Is Responsible For The Compliance Of The Functional And Utility Program With Applicable Law.11. The Contractor Will Provide The Ordering Party With The Prepared Functional And Utility Program In Two Copies, In Paper Form And In Electronic Form (Pdf).12. The Ordering Party Does Not Allow The Submission Of Variant Offers.13. The Ordering Party Does Not Allow Entrusting The Execution Of Part Of The Order To A Subcontractor.14. The Ordering Party Requires Contractors To Demonstrate That They Employ At Least One Person Under An Employment Relationship In Accordance With Art. 95 Of The Act, Which Will Participate In The Development Of The Functional And Utility Program. For This Purpose, The Contractor Attaches A Declaration, A Template Of Which Is Attached As Annex 4 To The Swz, That The Person Who Will Participate In The Performance Of The Order Is Employed Under An Employment Contract, If The Performance Of These Activities Involves The Performance Of Work In The Ma
