1/This Consultation Aims At The Conclusion Of Framework Agreements According To A Procedure With Negotiation, In Application Of Articles L 2124-3, R 2124-4 And R 2161-21 To R2161-23 Of The Public Order Code, Relating To The Provision Of Transport Services For Small Businesses.2/This Consultation Is Broken Down Into Two (2) Lots Designated As Follows: Lot N°1/ Regular School Transport Service By Coaches. The Services Performed By The Holder Are Intended To Serve Educational Establishments And Are Therefore Used, Primarily, By The Students Of Said Educational Establishments. Lot N°2/ Non-Urban Passenger Transport Service. Regular Non-Urban Coach Transport Service On Line 5 - La Bouilladisse / Gare Daubagne By Motorway. Regular Non-Urban Coach Transport Service On Line 11 - Cuges Les Pins - Aubagne Station. Regular Non-Urban Coach Transport Service On Line 8/9 - Saint Zacharie - Aubagne Station. Regular Non-Urban Coach Transport Service On Line 12 - Pont De Joux - Aubagne Station. Candidates Have The Opportunity To Bid For One, Several Or All Of The Lots. Offers Will Be Examined Lot By Lot. Candidates Cannot Submit Variable Offers Depending On The Number Of Lots Likely To Be Obtained. Each Lot Gives Rise To The Award Of A Separate Contract.4/The Services Are Described By The Specifications Of Special Technical Clauses (C.C.T.P), And The Execution Conditions Are Described In The Specifications Of Special Administrative Clauses (C.C.A.P).5/This Is A Procedure With Negotiation In Application Of Articles R2161-21 To R2161-23 Of The Cp.6/These Are Framework Agreements Within The Meaning Of Articles L2125-1.1° And R2162-1 Et Seq. Of The Public Order Code. 7/The Framework Agreements Are Executed By The Issuance Of Purchase Orders, Without Negotiation Or Prior Re-Competition, For The Services Described In The Contractual Documents (Purchase Orders Without Negotiation Under The Conditions Set Out In Articles R2152-13 And R2162-14 Of The Code) And In Part By The Conclusion Of Subsequent Contracts For The Needs Of Which Not All Contractual Stipulations Are Set Out In The Framework Agreement Documents (In Accordance With Articles R2162-7, R2162-11 And R2162-12 Of The Code).8/In Application Of Article R. 2162-4 Of The Code, Framework Agreements Are Concluded Without A Minimum Commitment Amount. They Are Concluded With The Maximum Commitment Amount As Appearing On The Corresponding Commitment Act, Over The First Duration, I.E. (3) Three Years, Namely: Lot N°1/Maximum Commitment Amount €21,000,000 Excluding Tax Lot N°2/Maximum Commitment Amount €22,000,000 Excluding Tax 9/For The Renewal Periods, I.E. One (1) Year For Each Renewal, The Framework Agreements Are Concluded Without A Minimum Commitment Amount. The Framework Agreements Are Concluded With The Maximum Commitment Amount, Namely: Lot N°1/Maximum Commitment Amount 7,000,000 Excluding Vatlot N°2/Maximum Commitment Amount 8,000,000 Excluding Vat10/The Amount Of Services Due Will Depend On The Purchase Orders Issued, For Each Of The Lots.11/Lot N°1/ As An Indication, Below Are The Estimated Kilometers, On The First Period, I.E. Three (3) Years, Is 569,475 Km, Or 189,825 Km Annually.12/Lot N°2/ As An Indication, Below Are The Estimated Kilometers, Over The First Period, I.E. Three (3) Years, Is 2,441,307 Km, I.E. 813,769 Km Annually.13/ These Framework Agreements Are Service Contracts. They Refer To The Ccag Applicable To Public Supply And Service Contracts (Ccag/Fcs) Approved By The Decree Of March 30, 2021.14/The Initial Duration Of Framework Agreements Is Set At (3) Years, From The Date Of Notification. They Are Tacitly Renewable Twice, Unless Tpe Decides Otherwise In Writing, Communicated With Notice Of 3 Months Before The End, By Registered Letter With Postal Acknowledgment Of Receipt.
