1. The Subject Of The Order Is The Supply Of Brand New 9 Mm Training Pistols.2. A Detailed Description Of The Subject Of The Order Is Attached As Annex No. 4 To The Swz And Technical Specification - Annex No. 5 To The Swz.3. The Ordering Party Does Not Allow The Submission Of Variant Offers.4. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Essential Provisions Of The Contract, Constituting Annex No. 6 To Swz.5. Pursuant To Art. 310 Of The Act, The Ordering Party May Invalidate The Contract Award Procedure If The Public Funds That The Ordering Party Intended To Use To Finance All Or Part Of The Order Were Not Awarded To It.6. The Ordering Party Reserves That The Total Value Of The Order May Not Exceed Its Financial Resources.7. The Ordering Party Provides For The Possibility Of Exercising The Option Right Referred To In Art. 441 Of The Act. The Option Right Can Only Be Used After 100% Of The Value Of The Basic Order Has Been Completed, If There Are Financial Resources And There Is A Need To Order A Larger Number Of Guns Than Those Provided For In The Basic Scope. The Value Of The Contract Awarded Under The Option Right Depends On The Financial Resources Available.8. The Ordering Party Provides For The Possibility Of Exercising The Option Right To The Extent Indicated In The Contract, At The Prices Specified In The Offer, Subject To The Provisions Of This Contract.9. The Ordering Party Reserves That The Part Of The Order Defined As An Option Is An Entitlement, Not An Obligation, Of The Ordering Party. The Option May Or May Not Be Exercised, Depending On The Financial Capabilities Of The Ordering Party. Failure To Complete The Order In This Respect Will Not Result In Any Claims From The Contractor.10. If The Option Right Is Exercised, Settlement Will Take Place On The Terms Set Out In The Concluded Contract.11. The Contractor Is Obliged To Deliver The Subject Of The Contract: A) As Part Of The Basic Order In An Amount Of 100 Pcs. Up To 150 Calendar Days From The Date Of Conclusion Of The Contract, B) Under The Option Right In An Amount Of Up To 50 Pcs. No Later Than The End Of The Third Week Of December 202612. The Contractor Will Deliver The Subject Of The Agreement To The Ordering Party To The Armament Warehouse Of The Police Training Center In Legionowo, Ul. Zegrze 121, 05-119 Legionowo.13. The Subject Of The Contract Will Be Marked And Delivered By The Contractor In Standard, Non-Returnable Packaging, Corresponding To The Properties Of The Subject Of The Contract And Protecting It Against Damage During Transport And Storage.14. The Acceptance Of The Subject Of The Contract Will Consist In Carrying Out A Quantitative And Qualitative Acceptance And Confirming The Compliance Of The Subject Of The Contract With The Description Contained In The Swz And Signing The Quantitative And Qualitative Acceptance Protocol With A Positive Result.15. The Acceptance Will Be Carried Out With The Participation Of Repres
