4.1. The Subject Of The Order Is The Purchase And Subsequent Delivery Of Granite Aggregate With A Continuous Grain Size Of 0-31.5 Mm Meeting The Parameters For Unbound Mixtures In Accordance With Wt-4 2025 For The Basic Foundation, Hereinafter Referred To As The Aggregate Intended For Repairs Of Dirt Roads In The Lutomiersk Commune. The Grain Size And Required Properties Are Specified In Annex 1 To The Contract. 4.2. It Is Assumed That The Scope Of The Order Covered By The Contract Will Be 5,500 Tons Of Aggregate. In Fact, The Ordered Quantity May Decrease Or Increase, But Not By More Than 15% Of The Estimated Order Quantity. 4.3. The Contractor Will Deliver The Aggregate Using Its Own Transport, Successively In Batches, To The Roads Indicated By The Ordering Party In The Lutomiersk Commune And To The Municipal Square Located In Lutomiersk At Ul. Kilińskiego 57, From 7:30 A.M. To 2:00 P.M., On Business Days (Monday To Friday), After Prior Notification Of The Order By The Ordering Party Within 2 Business Days. 4.4. The Contractor Declares And Guarantees That The Delivered Aggregate Is Free From Defects, Meets The Parameters And Technical And Operational Requirements Specified In The Contract, Has A Declaration Of Performance Issued By The Manufacturer Confirming The Compliance Of The Aggregate With Applicable Regulations. Standards And Physical And Chemical Properties, Meets Applicable Standards And Has The Appropriate Certificate And Does Not Contain Elements Harmful To The Environment (E.G. Asbestos, Ashes, Etc.) Or Hazardous To Road Users (Metal, Wire, Etc.). 4.5. The Basis For The Receipt Of Each Delivery Of The Ordered Aggregate (Single Car) Will Be The Wz Document Provided By The Contractor Along With A Weight Printout. 4.6. For Each Delivery (Single Car), The Contractor Will Provide A Wz Document Issued By The Manufacturer. Aggregates Declaration Of Performance.4.7.Each Time, The Ordering Party Has The Right To Commission An Independent Research Center To Carry Out Quality Tests Of Any Selected Samples Of The Delivered Aggregate To Verify Their Compliance With The Parameters Specified In The Contract.4.8.The Settlement Of Aggregate Deliveries Will Be Based On Partial Invoices. The Contractor Will Issue Partial Invoices After The End Of The Month, No Later Than By The 10Th Day Of The Month Following The Month In Which The Deliveries Took Place. Before Issuing An Invoice. The Contractor Will Provide A Detailed List Of Aggregate Deliveries In Accordance With Annex No. 2 To The Contract. Payment Of The Remuneration Will Be Made Within 14 Days From The Date Of Receipt Of A Correctly Issued Invoice By The Ordering Party, By Transfer To The Contractors Bank Account Indicated On The Invoice. 4.9. Deliveries Cannot Include Aggregate Produced From A Type Of Rock Other Than Granite. The Contractor Represents And Guarantees That The Delivered Aggregate Is Placed On The Market And Used In The Performance Of Road Works To The Extent Appropriate To Its Fu
