Road-Maintenance Works – Framework Agreement With A Maximum Of 3 Economic Operators For Modernization, Maintenance And Repair Works Of The Streets Within The Radius Of The City Of Zărnești, Including The Execution Of Various Emergency Repairs. The Object Of The Framework Agreement Is The Performance Of The Modernization, Maintenance And Repair Works Of The Streets Within The Radius Of Zarnesti City, Including The Execution Of Various Current Or Emergency Repairs That May Occur During The Four Years Of The Framework Agreement. The Following Were Taken Into Account: - The Multitude And Diversity Of The Works To Be Executed - The Need To Provide Services Throughout The Duration Of The Framework Agreement. - Ensuring The Permanent Necessary Qualified Personnel In Order To Fulfill The Contractual Obligations. - Ensuring The Necessary Funds For Carrying Out The Mentioned Activities Are Foreseen And Approved Annually In The Budget Of The Municipality Of Brasov. - The Works Which Are The Subject Of The Framework Agreement And Which Are To Be Executed Are Of A Permanent Nature And By Concluding A Framework Agreement, The Contracting Authority Has The Possibility To Conclude Subsequent Contracts Depending On The Need. In Accordance With Art. 115, Paragraph (1) And Paragraph (2), Letter A) From Law No. 98/2016 On Public Procurement, The Contracting Authority Establishes The Award Of The Framework Agreement, For A Period Of Validity Of 4 Years, To A Maximum Number Of 3 Economic Operators Who Meet All The Requirements Of The Procurement Award Documentation, For The Following Reasons: A) The Execution Of The Works That Are The Subject Of The Framework Agreement Assume A High Complexity Generated By The Diversity Of Activities And The Multitude Of Operations To Be Performed, Labor Differentiated By Categories Of Work, As Well As The Use Of Various Materials; B) The Execution Of The Works That Are The Subject Of The Framework Agreement Is Required Throughout The Year, And The Subsequent Contracts That Will Be Awarded Will Have The Same Purpose And The Same Nature As That Of The Framework Agreement. C) Obiectul Acordului-Cadru Impune, În Sarcina Executantului, Asigurarea Permanentă De Personal Calificat În Vederea Îndeplinirii Obligaţiilor Contractuale; D) The Street Maintenance Works Predicted To Be Carried Out In Order To Fulfill The Object Of The Framework Agreement Assume An Established And Adequate Repeatability, Repeatability Necessary For The Safe Maintenance Of Public Roads In The City Of Zarnesti;
