Minibuses - Public Procurement Contract For The Supply Of Electric Minibuses Within The Project Purchase Of Electric Microbuses For Students In Iați County, Code 14. Public Procurement Contract For The Supply Of Electric Minibuses Within The Project Purchase Of Electric Microbuses For Students In Iaşi County, Code 14 - According To The Specifications And Annex To The Specifications - Appendix - Minimum Technical Specifications And Equipment - Supply Of Electric Minibuses Within The Project Purchase Of Electric Microbuses For Students In Iaşi County, Code 14. Products Requested: Electric Minibuses Of 16+1 Seats = 5 Pcs. The Technical, Functional And Safety Specifications, Facilities And Equipment Are Contained In The Annex To The Specifications And Are Constituted By Minimum Requirements, Respectively Terms Of Reference, Which Are An Integral Part Of The Award Documentation. The Awarding Procedure Is Initiated Under The Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract For <>, Will Be Carried Out Only To The Extent That: A) Financing Contract No. 12001/ 12.09.2023 Is Extended After 31.03.2026 And B) At The Time Of Concluding The Purchase Contract, It Is Objectively Assessed That The Period Required For Delivery, Reception And Payment Falls Within The Implementation Period Provided For In The Financing Contract. In Accordance With The Provisions Of Law No. 98/2016 And Of H.G. No. 395/2016, The Bidders Participating In This Procedure Expressly Accept The Use Of The Mentioned Suspensive Clause And Fully Assume The Risks Associated With A Possible Non-Conclusion Of The Contract, Without Being Able To Claim From The Contracting Authority Compensation, Compensation Or The Recovery Of Any Losses That Could Arise From This Situation. By Submitting The Offers, The Bidders Undertake To Extend The Validity Of Their Offer And Participation Guarantee, At The Request Of The Contracting Authority, In The Event Of The Application Of The Suspensive Clause, Until The Situation Regarding The Extension Of The Financing Is Clarified And The Actual Possibility To Conclude The Contract. Considering The Provisions Of Law No. 98/ 2016 And Government Decision No. 395/2016, The Iaşi County Council, As The Contracting Authority, Specifies That It Will Conclude A Contract With The Bidder Declared The Winner To The Extent That There Will Be Funds Available For The Purchase, Respectively Non-Refundable Funds, By Extending The Duration Of The Financing Contract No. 12001/ 12.09.2023 And Of The Implementation Period Of The Project Purchase Of Electric Microbuses For Students In Iaşi County. Currently, The Duration Of The Financing Contract No. 12001/ 12.09.2023 And The Implementation Period Of The Project Is 31.03.2026. In The Situation Where, Regardless Of The Reasons, The Extension Of The Financing Is Not Approved After 31.03.2026 And If There Is An Objective Risk Of Non-Implementation Of The Contract Within The Term Related To The Project, The Contracting Authority Reserves The Right To Apply The Provisions Of Art. 212 Para. (1) Lit. C)
