The Subject Of The Order Is The Purchase Of Small Medical Materials And Products. A Detailed Description Of The Subject Of The Order Is Set Out In Annex No. 2 To These Terms Of Reference. The Subject Of The Order Is Free From Physical And Legal Defects, Brand New, Not Previously Used By Third Parties, In Particular It Was Not Used For Demonstration Purposes And Is Of Good Quality. It Has Also Not Been Previously Reconditioned. The Contractor Undertakes To Perform The Subject Of The Order In Accordance With All The Requirements Of The Ordering Party Indicated In This Tor. The Contractor Is Obliged To Submit An Offer For The Entire Given Part(S) Selected By Him/Her, Including All Items Of A Given Part. All Requirements Specified In The Procedure Documents Are Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law. If The Ordering Party Has Indicated In The Description Of The Subject Of The Order Trademarks, Patents Or Origins, Sources Or A Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Is Allowed To Offer Solutions Equivalent To Those Described, Provided That They Maintain The Same Minimum Technical, Quality And Functional Parameters. If The Description Of The Subject Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Ordering Party Allows Solutions Equivalent To Those Described. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards.
