Data-Transmission Equipment – ​​Public E-Services For Residents Of The Biskupiec Commune. The Subject Of This Order Is The Implementation Of Services, Purchase Of A Telemetry System With Radio Modules For Data Transmission With Installation And A Water Measurement System In The Biskupiec Commune As Part Of A Project Co-Financed By The Regional Program European Funds For Warmia And Mazury 2021-2027 Co-Financed By The European Regional Development Fund. The Order Includes The Purchase And Installation Of Radio Data Transmission Modules With Assembly And Measurement System In The Amount Of 5,195 Pieces (Various Types/Parameters). A Detailed Description Of The Order Is Included In Annex 1 To The Swz. The Description Of The Subject Of The Order May Indicate Trademarks Or Origin For Some Materials Or Devices; The Ordering Party Allows The Offer Of Materials Equivalent To Those Indicated In The Description Of The Subject Of The Order, Provided That They Guarantee The Implementation Of The Subject Of The Order In Accordance With The Decisions Obtained, Ensure That Parameters Are At Least At The Same Level As Assumed And Are Not Inferior In Terms Of: A) Functional Character (Identity Of Function), B) Technical Parameters (Strength, Durability, Technical Data), C) Safety Parameters Of Use. The Ordering Party Allows The Submission Of Equivalent Offers In Accordance With Art. 99 Section 5 And Art. 101 Section 4 Of The Public Procurement Law, However, The Requirements And Technical Parameters And Standards Specifying The Subject Of The Order Provided By The Ordering Party Are The Minimum Conditions That The Ordering Party Will Expect To Be Met. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Together With Its Description Or Standards. The Contractor Is Obliged To Present An Offer Covering The Entire Order, Because The Order Has Not Been Divided Into Separate Parts And Must Be Completed In Its Entirety. Justification For The Lack Of Division Into Lots: The Ordering Party Did Not Divide The Contract Into Parts Because Such A Division Would Pose The Risk Of Excessive Technical Difficulties And Excessive Costs Of Contract Execution. The Implementation Of The Procedure In Question By Different Contractors Implementing Individual Parts Of The Contract Is Unjustified For Logistical And Organizational Reasons, The Need For Strict Correlation Of Simultaneous And Subsequent Activities And Due To The Specific Nature And Result Of Obtaining A Coherent System And Could Seriously Jeopardize The Proper Performance Of The Contract.
