1. The Subject Of The Order Is The Successive Delivery Of New Dressing Materials For The Needs Of The Ordering Party. 1) The Order Includes Delivery According To The Assortment And In The Quantity Indicated On The Assortment And Price Form Constituting Annex No. 2 To The Swz, The Quantities Presented Therein Include A Summary For A Period Of 12 Months. Actual Quantities Will Result From The Current Needs Of The Ordering Party. The Ordering Party Will Complete The Order For At Least 60% Of The Contract Value.2) The Product Range Constituting The Subject Of The Order Must Meet The Requirements Contained In The Relevant European Standards And Be Admitted To Trading And Use In Accordance With The Provisions Of The Act Of April 7, 2022 On Medical Devices (Consolidated Text: Journal Of Laws Of 2024, Item 1620). At Each Request Of The Ordering Party, The Contractor Is Obliged To Submit Current Copies Of Documents Confirming The Required Authorization For Marketing And Use In Poland. 3) Together With The Subject Of Delivery, The Contractor Will Lend To The Ordering Party, For The Duration Of The Contract Concluded As A Result Of The Resolution Of These Proceedings, 2 Pieces Of Sleeve Welding Machines Necessary For The Operation Of The Offered Subject Of The Order. 4) The Ordering Party Allows For The Possibility Of Changing The Essential Terms Of The Contract, I.E. Changing The Type Of Dressings If It Is Necessary Due To: The Health Condition Of The Treated Patients, Withdrawal Of Dressings From Production During The Execution Of The Contract. 5) The Ordering Party Does Not Allow For The Possibility Of Arbitrary Changes To Those Proposed In The Offer By The Contractor. Dressing Materials Without The Acceptance Of The Ordering Party.6) The Ordering Party Requires That The Delivery Of The Subject Of The Order Takes Place Successively, At The Expense Of The Contractor, Based On Submitted Partial Orders. Orders Will Be Placed By Telephone, Electronically Or In Writing. 7) Deliveries Will Be Made On Business Days From Monday To Friday During The Ordering Partys Working Hours From 7:00 A.M. To 2:30 P.M. 8) The Contractor Will Ensure Delivery Of The Subject Of The Contract On Business Days, Within 3 Days From The Date Of Placing The Order. 9) The Goods Will Be Delivered To The Ordering Party In The Intact, Original Manufacturers Packaging Guaranteeing Quality And Sterility And In Such A Way That Its Performance Properties During The Expected Use Do Not Deteriorate During Transport And Storage, On Cost And Risk Of The Contractor. The Goods Will Be Delivered To The Ordering Partys Pharmacy, Address: Ul. Rzewuskiego 4, 28-100 Busko-Zdrój. 10) The Subject Of The Order Is New, Unused, Free From Physical And Legal Defects, Safe For People And The Environment, And Meets The Requirements Of Relevant Standards And Regulations. 11) The Contractor Is Responsible For The Compliance Of The Product With The Quality Requirements Specified For The Subject Of The Order.
