1. The Subject Of The Order Is The Delivery Of A Brand New, Unused Forklift Powered By Lpg, Which Was Manufactured At Least In 2025. 1.1. The Forklift Should Be Technically Efficient (Free From Material And Workmanship Defects), Complete And Ready For Use. The Subject Of The Order Cannot Be Intended By The Manufacturer To Be Withdrawn From Production Or Sale Due To Design Defects, Cannot Be A Prototype Or Come From A Presentation. It Should Be Free From Legal Defects And Cannot Constitute A Burden On Third Parties/Entities And Cannot Be The Subject Of Any Proceedings Or Security.1.2. The Forklift Will Be Adapted To Work In The Recyclable Raw Materials Sorting Hall And On The Premises Of The Municipal Waste Processing Plant For Loading And Unloading, In Particular: - Asbestos, - Self-Unloading Bins, - Baled Waste Paper And Pet.2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 2 To Swz.3. Pursuant To Art. 16B Section 2 Of The Public Procurement Law, The Ordering Party Does Not Allow The Offer (Delivery) Of The Subject Of The Contract From Third Countries That Are Not Parties To International Agreements, I.E. Countries That Are Not Members Of The European Union And Other Than Countries That Are Parties To The Agreement Of The World Trade Organization On Government Procurement Or Parties To Other International Agreements Guaranteeing Access To The Public Procurement Market On The Basis Of Reciprocity And Equality, To Which The European Union Is A Party (E.G. China, Turkey, Kazakhstan, India, Russia, Belarus, Brazil).3.1. The Offer Of The Contractor Offering The Subject Of The Contract From Third Countries That Are Not Parties To International Agreements Will Be Rejected Pursuant To Art. 226 Section 1 Point 5) Of The Public Procurement Law, Regardless Of The Origin Of The Contractor. 3.2. Pursuant To Art. Delivery And Collection Of The Forklift Being The Subject Of The Order Will Take Place On Working Days From 7:00 A.M. To 2:30 P.M. At The Municipal Waste Processing Plant, Ul. Dorohuska 70, 22-100 Chełm.5. The Offer Should Include The Valuation Of All Accompanying Services, Indirectly Related To The Subject Of The Proceedings, I.E. In Particular: Delivery Of The Subject Of The Order, Training Of Employees In The Operation Of A Forklift.6. The Minimum Warranty Conditions Are Specified In Annex 3 To The Swz.
