The Task Includes: Partial Renovation Of Asphalt Surfaces, With Emulsion And Grit Using A Renovator, The Depth Of Defects (Potholes) Is Approximately 4 Cm. The Scope Of The Basic Task Includes The Total Mass Used To Repair Defects On Municipal Roads In The Niepołomice Commune, Weighing 250 Tons. The Scope Of The Task Using The Option Law Includes The Total Mass Used For Repairing Repair Of Defects On Municipal Roads In The Niepołomice Commune Up To A Maximum Of 50 Tons. The Ordering Party Will Exercise The Option Right When It Is Found That The Roads Are In Poor Condition After The Winter And There Is A Need To Repair With A Renovator A Surface Larger Than That Of The Basic Task. A Detailed Description Of How To Perform The Order Is Included In The Technical Specification For The Execution And Acceptance Of Works And The Bill Of Quantities. Conditions Of The Option: 1) The Ordering Party May Exercise The Option Right Described In The Order Documents. 2) An Order Under The Option Right Is Made By The Ordering Party Unilaterally Submitting A Declaration Of Will To Activate The Option. 3) The Ordering Party May Use Only Part Of The Order Including The Option Right, Depending On Its Funds.4) An Order Implemented Under The Option Is A Unilateral Right Of The Ordering Party, Therefore, The Ordering Partys Failure To Exercise The Option Right Does Not Constitute A Basis For The Contractor To Pursue Any Claims Against The Ordering Party.5) The Ordering Party Will Inform The Contractor Whether And To What Extent It Will Exercise The Option Right, Within The Contract Implementation Period.6) In The Event Of Exercising The Option Right In The Last Two Months Of The Implementation Of The Basic Order, The Ordering Party Has The Right To Extend The Contract Execution Time By The Time Necessary To Complete The Order Covered By The Option Right.7) The Ordering Party Will Activate The Option If It Has Funds To Carry Out Tasks Related To The Partial Renovation Of Asphalt Surfaces.8) The Rules Regarding The Execution Of The Order Covered By The Option Right Will Be The Same As Those Applicable To The Implementation Of The Basic Order.
