1. The Subject Of The Order Are Road Works Related To The Ongoing Maintenance And Renovation Of Streets With Bituminous Surfaces Of Municipal Category Roads Managed By The Capital City Of Warsaw Targówek District. The Ongoing Maintenance Of Streets Consists In Particular In: Maintaining Facilities And Their Elements In Current Technical Condition And Performing Ad Hoc Failure Protection In The Event Of Their Occurrence, To The Extent Consistent With The Draft Provisions Of The Contract, Constituting Annex No. 5 To The Swz. The Subject Of The Order, In Particular The Description Of Construction Works And The Requirements Imposed On Them, Are Described In: 1) Bills Of Quantities Constituting Annex No. 6 To The Swz. The Bills Of Quantities Constitute The Basis For The Preparation Of The Offer Cost Estimate By The Contractor Using The Simplified Method. 2) Technical Specification For The Execution And Acceptance Of Construction Works (Stwiorb) Constituting Annex No. 7 To The Swz; 3) Draft Provisions Of The Contract.2. Equivalent Solutions. The Ordering Party Allows Equivalent Solutions Described In The Swz And Annexes. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Materials He Offers Meet The Equivalence Criteria Specified By The Ordering Party In Annex No. 8 To Swz.3. The Scope Of Works: A) Necessary To Be Performed, Includes Road Works Related To The Ongoing Maintenance Of Municipal Roads In The Targówek District Of The Capital City Of Warsaw With The Main Code Cpv 45233142-6 Road Repair Works. B) Accompanying Works To Be Performed Includes: - Preparation Of A Traffic Organization Design For The Duration Of The Works Along With Obtaining A Permit To Enter The Area, - Preparation Of Complete As-Built Documentation (At Each Request Of The Ordering Party).4. The Ordering Party Does Not Allow The Submission Of Partial Offers.5. The Ordering Party Does Not Divide The Order Into Parts. Justification: The Ordering Party Does Not Divide The Order Into Parts: A) The Subject Of The Order Includes The Construction, Maintenance And Renovation Of A Complete Civil Engineering Building (A Street With An Asphalt Surface, A Bicycle Path), Which Should Be Understood As The Result Of All Construction Works In The Field Of Civil Engineering, Which May Independently Fulfill An Economic Or Technical Function. Due To The Above, Only The Subject Of The Contract Performed Within The Scope Described Above Will Be Complete And Will Fulfill An Independent Technical Function. B) Dividing The Contract Into Parts Does Not Guarantee Proper Performance Of Construction Works, Because The Execution Of Each Part Separately Requires Interference With Other Parts And Elements Of The Executed Contract Or Suspending The Execution Of A Given Part Of The Contract In Order To Perform Another Part Of The Contract, Which Will Lead To Unjustified And Uneconomic, But Necessary Technological Breaks In The Performance Of The Subject Of The Contract.
