Where A Clear And Comprehensible Definition Of The Subject Of Public Procurement Made It Necessary To Refer To A Product Of A Specific Make, Origin, Or Type, The Designation Was Made In Order To Clearly Define The Nature Of The Subject And Bidders May Also Offer Or Equivalent Products Instead Of Products Of The Specified Make And Type. (X. 30.) In Accordance With Section 46 (3) Of Government Decree. Equivalence Must Be Proven To The Tenderer. It Is Therefore The Bidders Duty To Prove In The Bid That The Offered Product Is Equivalent To The Product Specified By The Bidder. Any Non-Acceptance Will Be Justified By The Bidder.
