Electricity, Heating, Solar And Nuclear Energy – Supply Of Electricity To The Facilities Of The Wieliczka Salt Mine. 1. The Subject Of The Order Is The Sale Of Electricity To The Ordering Partys Facilities, In The Quantities And Under The Conditions Specified In These Terms Of Reference. 2. The Subject Of This Order Does Not Include The Provision Of Distribution Services. 3. Electricity Will Be Sold Through The Distribution Network Belonging To The Distribution System Operator Tauron Dystrybucja S.A., With Which The Ordering Party Has Signed Contracts For The Provision Of Distribution Services And Is Settled According To The B23 Tariff Group. 4. The Ordering Party Informs That: 1) The Measurement Systems Are Adapted To The Tpa Rules And Meet The Requirements Set By The Instruction For The Operation And Operation Of The Distribution Network Of Tauron Dystrybucja S.A. Category B3 Measurement Systems, 2) Separate Agreements For The Distribution And Sale Of Electricity Are Concluded For The Facilities To Which Electricity Will Be Supplied. 5. Maximum Amount Of Electricity: 5.1 As Part Of The Implementation Of This Order, The Ordering Party Undertakes To Purchase A Maximum Of 16,000 Mwh, Including: 1) For Connection No. 1 - An Estimated 9,350 Mwh, 2) For Connection No. 2 - An Estimated 6,000 Mwh, 3) For Connection No. 3 - An Estimated 500 Mwh, 4) For Connection No. 4 – Estimated 150 Mwh. Including: - In The Morning Peak - 4,040 Mwh, - In The Afternoon Peak - 3,020 Mwh, - During The Remaining Hours Of The Day - 8,940 Mwh. 5.2 Electricity Will Be Purchased According To The Ordering Partys Needs Resulting From The Actual Consumption Of Electricity. The Ordering Party Undertakes To Purchase The Electricity Referred To In Point 5.1, Worth 70% Of The Total Gross Price. The Remaining Part Of The Electricity, Worth 30% Of The Total Gross Price, Will Be Purchased By The Ordering Party Depending On Its Needs (Option Right). 5.3 Quantities Given In Point 5.1 Cannot Be The Basis For Any Claims On The Part Of The Contractor To The Extent Exceeding The Minimum Value Indicated In Point. 5.2. 6. Measurement Of The Supplied Electricity Is Carried Out By Measurement And Billing Systems. 7. Additional Conditions 7.1 Electricity Purchased Under This Order Will Be Used For The Needs Of The Final Buyer Within The Meaning Of The Act Of December 6, 2008 On Excise Duty. 7.2 The Share Of Energy Generated From Renewable Energy Sources (Res) In The Energy Sold Should Be 100%. The Supplied Electricity From Renewable Energy Sources (Res) Should Be Documented With Documents Confirming The Quantity And Source Of Origin. 7.3 The Supplied Electricity From Renewable Energy Sources (Res) Should Be Documented With A Guarantee Of Energy Origin Issued By The President Of The Energy Regulatory Office, Kept In The National Register Of Guarantees Of Origin, In Accordance With The Act Of February 20, 2015 On Renewable Energy Sources, As Amended. Amended, Relevant Implementing Regulations And Guidelines Issued By The President Of The Energy Regulatory Office, Including On Registers Of Guarantees Of Origin, According To The Applicable
