The Subject Of The Order Implemented In The Design And Build Formula Is The Construction Of A Transfer Hub In Zabierzów Bocheński Along With Land Development And The Necessary Technical Infrastructure And Installations. The Investment Task Is Co-Financed By The European Funds For Infrastructure, Climate And Environment, Fenx Measure 3.01 Urban Transport. The Order Includes: 1. Stage I - Development Of Complete Multi-Discipline Design And Implementation Documentation (In Accordance With The Pfu Description) Along With Obtaining A Building Permit. Documentation Of The Entire Investment Should Be Prepared In 4 Copies In Paper Form And 1 Copy In Electronic Form, With The Reservation That The Electronic Documentation Must Be Prepared: A Descriptive Part In The Ms Office Package In Doc And Pdf Formats, Drawings - In Pdf And Dwg Formats. The Contractor Declares That On The Date Of Transfer To The Ordering Party Of Any Results Of Services Provided Under This Agreement, Having The Characteristics Of A Work Within The Meaning Of Copyright Law (Hereinafter: Works), He Will Be Entitled To Exclusive Copyrights To The Works And That He Will Be Entitled To Grant The Ordering Party The Permissions Referred To In This Agreement. The Contractor Represents And Guarantees That The Works, At The Time Of Transfer Of Ownership Of The Copyrights To The Ordering Party, Will Not Infringe Any Intellectual Property Rights Of Third Parties And Will Not Be Encumbered With Any Third Party Rights. The Contractor Hereby Undertakes To Repair Any Damage, Including To Cover All Costs And Expenses, Including Legal Fees Incurred By The Ordering Party In Connection With Any Lawsuit, Claim Or Proceeding Brought Against It As A Result Of The Contractors Submission Of False Statements Regarding Its Intellectual Property Rights. In Particular, The Contractor Undertakes To Join The Process On The Side Of The Ordering Party Or To Join The Process In His Place.2. On The Date Of Final Receipt Of The Design Documentation By The Ordering Party, The Contractor Transfers To The Ordering Party, Without The Obligation To Pay Additional Remuneration, The Copyrights To All Works, Without Time Limits, To Use And Dispose Of Them In Whole Or In Part In The Country And Abroad In The Following Fields Of Exploitation: 1) Recording And Reproducing The Design Documentation By Any Technique In Any Form, In Particular In The Memory Of Computers, Including Those Serving As Servers, Flash Memories, 2) Distributing The Design Documentation Without Any Restrictions Quantitative, Printing Technology, Computer Memory, Flash Memory, Digital And Magnetic Recording, As Well As In Multimedia Networks, Including The Internet,3) Implementation Of The Subject Of The Order.3.
