1. The Subject Of The Order Is The Delivery - Purchase, Based On An Operational Leasing Agreement With A Purchase Option, Of A Brand New Tractor With Accessories, I.E. With A Boom Mower And A Flail Mower, Hereinafter Collectively Referred To As Equipment. A Detailed Description Of The Subject Of The Order Is Set Out In Annex No. 1 To The Swz - Description Of The Subject Of The Order, Hereinafter Referred To As Opz.2. The Delivered Equipment Must Be Free From Physical And Legal Defects, Brand New (Year Of Production 2025 Or 2026), Not Previously Used By Third Parties, And Not Used For Demonstration Purposes. It Has Also Not Been Previously Reconditioned. The Equipment Must Be Complete And Ready To Operate As Intended Upon Delivery.3. The Description Of The Subject Of The Order (Opz) In Terms Of Requirements For The Delivery Of Equipment Is Annex No. 1 To The Swz, The Leasing Rules Are Described In Annex No. 4 To The Swz And In Chapter Xxi Of This Swz.4. The Offered Equipment Cannot Be Produced In Countries Other Than Member States Of The European Union And Other Than Countries That Are Parties To The World Trade Organization Agreement On Government Procurement Or Parties To Other International Agreements Guaranteeing Access To The Public Procurement Market On The Basis Of Reciprocity And Equality, To Which The European Union Is A Party, I.E. The So-Called Third Countries Not Parties To International Agreements. If The Contractor Offers Equipment Manufactured In A Third Country That Is Not A Party To International Agreements, The Contractors Offer Will Be Rejected As Inconsistent With The Terms Of The Order.
