Detailed Requirements Regarding The Subject Of The Contract Constitute An Integral Part Of The Description Of The Subject Of The Contract And Are Included In Part Iv Of The Swz, Where, In Accordance With Art. 99 Section 6 Of The Public Procurement Law, The Contracting Authority Indicated The Criteria Used To Assess Equivalence. 3. The Contractor Is Obliged To Provide The Ordering Party With A Quality Guarantee Under The Terms Of The Manufacturers Warranty. The Warranty Requirements Are Specified In Parts Iii And Iv Of The Swz. 4. The Warranty Period Will Be Counted From The Date Of Preparation Of The Delivery And Acceptance Protocol Of The Subject Of The Order. 5. The Delivered Item Must Be Brand New, Not Exhibited At Exhibitions, Complete And Technically Functional. The Statement Brand New Should Be Understood As The Subject Of The Order In Its Original Packaging, Unused Before The Date Of Delivery, Excluding Use Necessary To Test Its Correct Operation After Production. 6. The Subject Of The Order Must Be Free From Any Physical And Legal Defects And Claims Of Third Parties. 7. The Delivered Subject Of The Order Must Come From The Manufacturers Distribution Channel, Which Does Not Exclude Distribution To The Polish Market And Ensures The Implementation Of Warranty Rights. 8. The Subject Of The Order Must Be Delivered Together With User Manuals, Drivers And Any Accompanying Software Necessary For The Proper Use Of The Subject Of The Order (Obtaining Full Functionality Indicated In Part Iv Of The Swz). The Ordering Party Will Not Be Obliged To Pay Any Additional Fees, In Particular License Fees, And Any Licenses Will Be Granted As Part Of The Contractors Remuneration, Without Time And Territorial Limits, Unless It Is Clearly Stated Otherwise In Part Iv Of The Swz. If Licenses, Codes Or Other Permissions Are Required To Run And Use This Software, They Must Be Provided At No Additional Charge. Codes, Licenses And Other Permissions Must Also Be Provided When They Are Necessary To Run Or Configure Hardware Components. 9. The Delivered Item Of The Order, Intended For Power Supply From The Power Grid, Must Be Equipped With An Appropriate Number Of Power Cables Allowing It To Be Connected To Standard Power Sockets, Unless Otherwise Stated In Part Iv Of The Swz. 10. On The Day The Offer Is Prepared, The Offered Subject Of The Order Cannot Be Intended By The Manufacturer To Be Withdrawn From Production Or Sale. 11. The Offered Subject Of The Order Must Have A Ce Compliance Mark (Ce Mark) Or A Declaration Of Compliance With Ce. If The Offered Subject Of The Contract Is Not Subject To The Obligation To Mark The Ce Mark, Such An Object Must Have A Declaration
