1. The Subject Of The Order Is Revitalization Of The Manor Park In Bludzie.2. A Detailed Description Of The Subject Of The Order Is Specified In Chapter Ii And Constitutes An Annex To The Specification Of Procurement Conditions (Hereinafter Referred To As Swz Or Specification).3. Pursuant To Art. 95 Section 1 Of The Act, The Ordering Party Requires The Employment Under An Employment Contract By The Contractor And/Or Subcontractor And/Or Further Subcontractor Of All Persons Performing The Activities Listed In Section 4, Specified In The Description Of The Subject Of The Order. No Later Than On The Date Of Commencement Of The Service, The Contractor Will Be Obliged To Employ, For The Duration Of The Order, Persons Performing The Activities Referred To In Section 4, Hereinafter Referred To As Employees, Under An Employment Contract Under Penalty Of Withdrawal From The Contract For Reasons Attributable To The Contractor.4. Type Of Activities (Necessary To Perform The Order), For The Performance Of Which The Ordering Party Requires The Employment Under An Employment Contract By The Contractor Or Subcontractor Of Persons Performing During The Execution Of The Order: 1) Earthworks, Cleaning Works - Cleaning The Area, Preparation Of The Site, Other Activities Of Manual Workers, 2) Machine Operators Of Equipment And Devices (Operation Of Equipment, Machines And Devices), Covering The Entire Scope Of The Contract Indicated In The Swz, Technical Documentation And This Agreement, Performing Work Covered By The Scope Of The Order Indicated In The Swz, Technical Documentation And The Contract - The Performance Of Which Contains The Features Of An Employment Relationship Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code5. The Ordering Party Requires The Contractor To Submit A Declaration That The Persons Assigned To Perform The Order Referred To In Section 3, Are Employed Under An Employment Contract. The Declaration Should Be Submitted No Later Than 7 Days From The Date Of Signing The Contract And Should Contain At Least The Following Data: Name And Surname Of The Employed Employee, Date Of Conclusion Of The Contract, Type Of Concluded Employment Contract, Period Of Employment, Position And Scope Of Responsibilities Of The Employee, For Each Person Assigned To Execute The Order. At Any Stage Of Order Execution, The Ordering Party May Request Copies Of Employment Contracts And/Or Other Documents Referred To In Art. 438 Section 2 Of The Act, Which Will Clearly Show That The Persons Assigned To Execute The Order Are Employed Under An Employment Contract.6.
