1. The Subject Of The Order Is The Purchase Of A Used, Medium-Sized Fire Truck For The Volunteer Fire Department In Rzymkowice 2. The Minimum Technical Parameters Are Described In Detail In Annex No. 4 To The Swz. 3. The Subject Of The Contract Also Includes: A) Transfer Of Complete Documentation Necessary To Admit The Vehicle To Traffic In Poland, An Operating Manual And The Vehicles Declaration Of Conformity In Polish, B) Transfer Of A Fully Fueled Vehicle, C) Training/Instruction Of 2 People From The Ordering Partys Staff In The Operation Of The Vehicle, Including The Chassis And Body, Carried Out At The Contractors Headquarters, D) The Ordering Party Will Collect The Vehicle From The Contractors Headquarters.4. The Ordering Party Envisages The Following Acceptances Under The Agreement: A) Partial Technical And Quality Acceptance, B) Final Acceptance.5. The Technical And Qualitative Acceptance Will Be Carried Out By An Acceptance Committee Composed Of 2 Representatives Of The Ordering Party And 1 Representative Of The Contractor At The Contractors Headquarters. The Acceptance Activities Include Verification Of Whether The Subject Of The Contract Meets The Parameters Specified In Annex 1 To The Agreement And The Offer. The Contractor Will Notify The Ordering Party Of Its Readiness For Technical And Quality Acceptance At Least 3 Days In Advance.6. An Acceptance Report Will Be Prepared Following The Technical And Quality Acceptance, Confirming The Compliance Of The Subject Matter Of The Contract With The Agreement Or Identifying Discrepancies As To The Content Of The Agreement. If The Compliance Of The Subject Of The Contract With The Agreement Is Confirmed, The Parties Will Specify The Date Of Final Acceptance In The Technical And Quality Acceptance Report.7. If, During The Technical And Quality Acceptance, Non-Compliance Of The Subject Of The Contract With The Requirements Specified In The Agreement Or The Offer Is Found, The Ordering Party May Refuse To Accept The Subject Of The Contract In Whole Or In Part Affected By Significant Defects Or Non-Compliance, Or The Parties Will Specify In The Technical And Quality Protocol A Deadline For The Contractor To Bring The Subject Of The Contract Into Compliance With The Agreement As Well As A Deadline For Carrying Out Another Technical And Quality Acceptance.8. If The Contractor, Despite The Information In The Technical And Quality Acceptance Report, Does Not Remove The Identified Non-Compliances Referred To Above Within The Prescribed Period, The Ordering Party Has The Right To Substitute Performance At The Expense And Risk Of The Contractor, Without Additional Request And Informing The Contractor Thereof. The Costs Of Substitute Performance Will Be Deducted From The Remuneration Due To The Contractor. For This Purpose, The Ordering Party Will Submit An Appropriate Document Of Substitute Performance And Submit An Appropriate Declaration Of Deduction.9. The Final Acceptance Will Be Carried Out By An A
