1. The Subject Of The Order Is The Delivery Of 29 Portable Computers, In Accordance With The Technical Conditions Indicated In The Assortment And Price Form, Constituting An Attachment To Swz.2. The Delivered Subject Of The Order Should Be Brand New, Complete, Meeting The Requirements Of Applicable Regulations, Free From Any Physical Defects As Well As From Any Legal Defects And Third Party Claims And Ready For Use In Accordance With Its Intended Purpose.3. If The Description Of The Subject Of The Order Includes An Indication Of Trademarks Or Origin, The Ordering Party Informs That This Provision Is Only A Definition Of Minimum Parameters And Constitutes An Indication For The Contractor What Features The Materials Or Devices Used To Implement The Subject Of The Order Should Have. The Ordering Party Allows The Order To Be Completed By Using Equivalent Materials Or Devices. The Contractor Who Offers Equivalent Materials Or Devices Is Obliged To Demonstrate In The Offer That They Meet The Requirements Of The Ordering Party.4. Pursuant To Art. 101 Section 4 Of The Public Procurement Law If The Documents Describing The Subject Of The Contract Include A Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, The Ordering Party Allows Solutions Equivalent To Those Described In Each Such Standard, Technical Assessment, Technical Specification, And Technical Reference System. Due To The Above, It Should Be Assumed That Each Standard, Technical Assessment, Technical Specification, System Of Technical References Appearing In The Description Of The Subject Of The Contract Is Accompanied By The Words Or Equivalent. Pursuant To Art. 101 Section 5 Of The Public Procurement Law, A Contractor Who Refers To Solutions Equivalent To Those Described In These Documents Is Obliged To Prove, By Attaching To The Offer, Appropriate Evidence Referred To In Art. 104-107 Pzp, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Contract.5. Concerning The Description Of The Subject Matter Of The Contract By Indicating Trademarks, Patents Or Origin, Source Or Specific Process. In The Case Of Offering Equivalent Products Specified In The Description Of The Subject Of The Order, The Contractor: A) Must Indicate In The Assortment And Price Form The Equivalent Product He Offers, B) Is Obliged To Submit, Along With The Offer, Appropriate Evidence (In The Form Of Catalog Cards With A Direct Reference To Alternative Solutions), Confirming That The Offered Products/Systems Meet The Equivalence Criteria Specified In The Description Of The Subject Of The Order, In Accordance With Art. 99 Section 6 Of The Pzp.6 Act.
