The Subject Of The Order Is The Supply Of Office Software For The Kwp In Łódź And Its Subordinate Units. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 2 To The Swz. The Contractor Undertakes To Deliver The Subject Of The Order In Quantities Consistent With The Quantities Indicated In The Description Of The Subject Of The Order - Annex No. 2 To The Swz. The Subject Of The Order Must Be Fully Consistent With The Description Of The Subject Of The Order (Appendix No. 2 To The Swz), Free From Physical And Legal Defects. The Contractor Guarantees That He Has Taken Possession Of The Goods Constituting The Subject Of The Order And Incurs All Fees Provided For By Law. The Delivered Software Licenses Will Entitle The Ordering Party To Download Corrections And Update The Software Without Time Limit Starting From The Date Of Delivery Of The Software In A Way That Does Not Infringe The Rights Of The Creators And The Copyright Owner And Does Not Limit The Ordering Partys Rights To Use The Software In Accordance With The Purpose Of The Contract. The Parties Provide For The Possibility Of Extending The Purchase With An Additional Order Under The Option Right Of A Maximum Of 50 Items, If The Ordering Party Has Funds Allocated For The Execution Of The Optional Order. The Contractor Undertakes To Deliver The Subject Of The Contract In Quantities Consistent With The Quantities Indicated In The Description Of The Subject Of The Order, Appendix No. 2 To The Swz, And In The Event Of Exercising The Option Right, With The Quantities Indicated In The Description Of The Subject Of The Order And The Order Placed Under The Option Right. An Additional Order Under The Option Right Will Include Software Identical To That Specified In Annex No. 2, While Maintaining The Unit Prices Included In The Offer Form - Annex No. 1 To The Swz. The Order Under The Option Right Will Be Submitted To The Contractor No Later Than On The Day Of Signing The Contract And Will Be Delivered To The Ordering Party Within The Time Specified In § 2 Section 1. The Ordering Party Reserves That Exercising The Option Right Is Its Right, Not An Obligation, And Will Take Place In Accordance With The Actual Needs Of The Ordering Party.
