Contract Award For Purchase Of Electric Energy Under Universal Service Conditions In 2024 Electric Energy Purchases (Pup) By Subject Of Procurement: Purchase Of Electric Energy Under Universal Service Conditions For The 2024 Calendar Year Under Dk 021:2015 Code 09310000-5 Electric Energy Law Of Ukraine On The Electric Energy Market Dated 04/13/2017 N 2019 - Viii (Further - Law N 2019) Defines The Legal, Economic And Organizational Principles Of The Operation Of The Electric Energy Market, Regulates Relations Related To The Production, Transmission, Distribution, Purchase And Sale, Supply Of Electric Energy To Ensure Reliable And Safe Supply Of Electric Energy To Consumers, Taking Into Account The Interests Of Consumers , Development Of Market Relations, Minimization Of Electricity Supply Costs And Minimization Of Negative Impact On The Natural Environment. At The Same Time, The First Part Of Article 3 Of Law N 2019, Which Establishes The Principles Of Operation Of The Electric Energy Market, Stipulates That The Electric Energy Market Functions On A Competitive Basis, Except For The Activities Of Natural Monopolies, With Restrictions Established By This Law. According To Clauses 67 And 93 Of Art. 1 Of Law N 2019 Universal Service Is The Supply Of Electricity To Household And Small Non-Household Consumers, Which Guarantees Their Rights To Be Provided With Electricity Of A Certain Quality Under The Conditions Determined In Accordance With This Law, Throughout The Territory Of Ukraine, And The Universal Service Provider Is Defined In Accordance With Of This Law, An Electricity Supplier That Fulfills Obligations To Provide A Universal Service. According To The Definition Given In Law N 2019, A Small Non-Household Consumer Is A Consumer Who Is Not A Household Consumer And Buys Electricity For His Own Consumption, Whose Electrical Installations Are Connected To Electrical Networks With A Contractual Capacity Of Up To 50 Kw. The Regional Communal Institution Chernivetsk Regional Center Of Social And Psychological Assistance Is A Small Non-Household Consumer, Since It Is Not A Household Consumer, It Buys Electricity For Its Own Consumption, The Electrical Installations Of Which Are Connected To Electrical Networks With A Contractual Capacity Of 50 Kw, Which Is Confirmed By The Passport Of The Point Of Distribution/Transfer Of Electricity Energy Therefore, The Customer Has The Right To Purchase Electricity On The Terms Of Universal Service. According To Paragraph 5 Of The Regulation On The Peculiarities Of The Supply Of Electricity To Consumers And Settlements Between Participants Of The Retail Electricity Market During The Period Of Martial Law In Ukraine, Approved By The Order Of The Ministry Of Energy Of Ukraine On April 13, 2022 No. 148, Registered In The Ministry Of Justice Of Ukraine On April 22, 2022. According To No. 441/37777 (Hereinafter Referred To As The Regulation On Special Features), Within The Territory Of The Licensed Activity Of One Universal Service Provider (Hereinafter Referred To As The Pup), It Is Not Allowed To Carry Out Activities Of Other Pups. According To Clause 4 Of The Regulation On The Peculiarities Of The Pup, It Is Obliged To Supply Electricity To The Consumer Of Electricity According To
