1) Part 1 - Purchase And Delivery Of A Scanner - The Subject Of The Order Is The Purchase And Delivery Of A 3D Scanner, In Accordance With The Technical Data Presented In The Description Of The Subject Of The Order. A Detailed Description Of The Subject Of The Order Is Attached As Annex No. 1 To Chapter Iii And Annex No. 1 To Chapter Ii Of The Terms Of Reference.11. The Ordering Party Allows The Contractors To Offer An Equivalent Subject Of The Contract, Provided That: 1) If The Ordering Party Describes The Subject Of The Contract By Indicating Trademarks, Patents Or Origin, It Should Be Understood That The Use Of Equivalent Solutions Is Allowed; 2) The Ordering Party Allows The Use Of An Equivalent Subject Of The Contract Provided That It Has At Least The Same Technical Parameters As Those Listed In The Description Of The Subject Of The Contract, Constituting Annex No. 1 Or 2 To Chapter Iii Of The Swz (Depending On The Part, To Which The Submitted Offer Will Apply); 3) The Contractor Is Obliged To Demonstrate That The Offered Product Meets The Requirements Of The Ordering Party; 4) All Products From Specific Manufacturers Specify The Minimum Quality Parameters And Functional Features That The Products Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only The Quality Standard Of The Subject Of The Order; 5) By The Provision Regarding The Minimum Requirements For Quality Parameters, The Ordering Party Understands The Requirements Of The Subject Of The Order Contained In Publicly Available Sources, Catalogs And Websites Of Manufacturers. The Use Of Exemplary Manufacturers Names Is Only Intended To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution. Therefore, The Use Of Manufacturer Or Product Names Is For Example Purposes Only. When Describing The Subject Of The Order, The Ordering Party, Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product, Also Allows Equivalent Products With Quality Parameters And Functional Features, At Least At The Level Of The Parameters Of The Indicated Product, Thus Accepting Every Product With The Indicated Parameters Or Better. In Such A Situation, The Ordering Party Requires The Submission Of Appropriate Documents Authenticating These Materials Or Devices And Attaching To The Offer An Appropriate Description Regarding Equivalence, In Accordance With The Provisions Of The Description Of The Subject Of The Order, Constituting Annex No. 1 Or No. 2 Or No. 3 To Chapter Iii Of The Swz (Depending On The Part To Which The Submitted Offer Will Concern); 6) If The Contractor Does Not Submit The Description And Documents Referred To In Point 5) Above With The Offer, It Is Understood As That The License Described In The Description Of The Subject Of The Order Was Used To Calculate The Offer Price.
